This is based on the fact that an investigation revealed the City was not liable for this incident. - Alderperson Rick motioned to disallow the 2022 claim. Alderperson Russell seconded and the motion passed. XI. General Agenda Items for Consideration 1. Consider the 2024-2025 Merrill Police Union contract. Mayor Hass is bringing this directly to the Common Council. - Alderperson Lupton motioned to approve. Alderperson Weix Jr. seconded and the motion passed. XII. Committee of the Whole 1. Take any action regarding the remaining unallocated ARPA funds of $9,999.76 from the earlier Committee of the Whole. - City Clerk Anderson-Malm read the actions from the earlier Committee of the Whole. Motion to use unallocated ARPA funds for the Food Truck-a-palooza and future Food Truck-a-palooza events. Alderperson Meyer motioned to approve the motion from the Committee of the Whole. Consider the bid for the M2024-02 paving project (S Center Avenue and N Sales St) to American Asphalt of Wisconsin Division of Mathy for $517,380.50. Consider a temporary Class "B" picnic license for the Lincoln County Fair Association, on August 7, 8, 9, 10, and 11, 2024 at the Merrill Festival Grounds in conjunction with the Lincoln County Fair. Consider implementing a hiring freeze, except for Police and Fire line positions; have vacant positions evaluated by the Personnel & Finance Committee and forwarded to the Common Council with the Mayor having the ability to bring a position directly to the Common Council. The Personnel & Finance Committee recommends approval. It was suggested by the Administration to include Transit personnel in the final action. - Alderperson Caylor motioned to amend the original motion to include Transit personnel. Alderperson Meyer seconded and the motion passed. 2. Consider the elimination of the Community Development Program Director position upon the retirement of the current employee, effective May 1, 2024. The Personnel & Finance Committee recommends approval. - Following discussion, which included Alderperson Caylor thanking the Community Development Program Director for her service over the past 27 years and Building Inspector/Zoning Administrator Pagel thanking the CDPD publically. Hobart WNAXLP Oneida Wetland Mitigation Site Invasive Species Control Robert E. Lee & Associates, Inc. has been contracted by the Wisconsin Department of Transportation (WisDOT) to spot treat 30 acres of invasive species (common reed (Phragmites australis), reed canary grass (Phalaris arundinacea), cattail (Typha spp), and purple loosestrife (Lythrum salicaria)) within the Oneida Wetland Mitigation Site (74 acres) located on the northwest side of the Village of Hobart. Work will begin in May and will conclude by October 31, 2024. All invasive species will be treated with an aquatic approved herbicide and follow guidelines provided by WisDOT, in order to reduce impacts to native plants and wildlife within the property. Herbicide treatments will be conducted by a combination of foliar spraying with a backpack sprayer or ATV tank sprayer, cutting stems and applying herbicide to the cut surface and hand wicking. Any request for a public meeting must be made within five days after this notice is published. The request must address the topics to be discussed at the meeting, including problems and alternatives, and must be sent in writing to the Wisconsin Department of Natural Resources, 2984 Shawano Avenue, Green Bay, WI, 54313 with attention to Claire Hetzel. Howard WNAXLP Preliminary Resolution No. 2024 - 11 PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE SPECIAL ASSESSMENT POWERS UNDER WISCONSIN STATUTE SECTION 66.0701 UPON THE PLAT OF HAZEL ESTATES SECOND ADDITION, FOR SANITARY SEWER, STORM SEWER, WATER MAIN, SERVICE LATERALS, SIDEWALKS, CURB AND GUTTER, ASPHALT ROADWAY AND STORM WATER MANAGEMENT FACILITY CONSTRUCTION. The Village Board of the Village of Howard, Brown County Wisconsin do hereby resolve as follows: 1. The Village of Howard hereby declares its intention to exercise its power under Section 66.0701 of the Wisconsin Statutes to levy special assessments upon The Plat of Hazel Estates Second Addition as follows: A. The Plat of Hazel Estates Second Addition for sanitary sewer and laterals, water mains and water services, storm sewer and laterals, sidewalks, curb and gutter, asphalt roadway, and storm water management facility construction including: Parcel VH – 4325 Parcel VH – 4326 Parcel VH – 4336 Parcel VH-32-2 2. The total amount assessed by the Village shall not exceed the cost of the improvements. 3. The Assessment against any parcel may be paid in cash or installments to be determined at the public hearing on the proposed assessment. 4. The Village determines that such improvements shall be installed and assessment therefore levied under the police power and that the amount assessed against each benefited parcel shall be based on the Village of Howard Special Assessment Policy for public improvements. 5. The Director of Engineering is directed to prepare a report consisting of: A. Preliminary or final plans and specifications. B. An estimate of the entire costs of the proposed work or improvement. C. A schedule of the proposed assessments. D. A statement that the property against which the assessments are proposed is benefited. 6. After completing such report, the Director of Engineering is directed to file a copy thereof in the Village Clerk’s office for public inspection. 7. Upon receiving the report of the Director of Engineering, the Village Clerk is directed to give notice of a public hearing on such report as specified in Section 66.0703(7), Wis. Stats., unless prior thereto a written waiver of such notice is received by the Clerk from the owners of all of the property affected by said public improvements against which assessments are to be levied. If such notice is required the hearing shall be held in the Village Hall at a time set by the clerk in accordance with Section 66.0703(7), Wis. Stats.
