The proposed project includes the replacement of water infrastructure, sewer infrastructure, storm sewer infrastructure, reconstruc-tion of roadway. The UGLG has determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and, accordingly, the UGLG has decided not to prepare an Environmental Impact Statement (EIS) under the National Environmental Policy Act of 1969 (PL 91-190). The reason for such decision is because the project will have no/low impact on the environment. A FONSI is necessary to document environmental assessment findings. The environ-mental assessment findings are regarding manmade/industrial oper-ations hazards and endangered resources/ species. Manmade and Industrial Operations Hazards: There are no hazardous industrial operations near the project area. There are no manmade hazards identified near the project area. In addition, there are no above-ground storage tanks near the project area. There is a closed remediation side near the project area (N Cedar). There are no mitigation measures required, however the prime construction contractor for the project will be notified of the location in the unlikely event that hazardous materials are present. Endangered Resources/Species: DNR portal utilized; This project is covered by the Broad Incidental Take Permit/ Authorization for No/Low Impact Activities (No/Low BITP/A). In addition, the No/Low BITP/A is applicable provided that follow-up actions are implemented to address the presence of the Rusty Patched Bumble Bee. It is has been determined that the project is not within suitable habitat and no further action is required. All agencies, groups or individuals disagreeing with this decision are invited to submit written comments to the above address. Such written comments should be received on or before 4/13/2024. All such comments will be considered, and the UGLG will not request the release of federal funds or begin the project prior to such date. On or about 5/1/2024, the UGLG will request the Division of Energy, Housing and Community Resources (DEHCR) to release Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383) as amended for this project. The UGLG is certifying to DEHCR that it and its chief executive officer, in his/her official capacity as Mayor, consent to accept the jurisdiction of the federal courts if an action is brought to enforce environmental review responsibilities, decision-making, and action; and that these responsibilities have been satisfied. Upon certification, the UGLG may use the CDBG funds, and DEHCR will have satisfied its responsibilities under the National Environmental Policy Act of 1969. DEHCR will accept an objection to the release of funds and certification only if (a) the certification was not executed by the chief executive officer or other officer of the UGLG approved by DEHCR; or (b) the UGLG’s EA indicates omissions of a required decision, finding, or step. Quantum Dairy LLC is owned and operated by Kurt Duxbury. It currently has 5,050 animal units and based on current herd size Quantum Dairy has approximately 219 days of liquid manure storage, and 59 days of solid manure storage. Quantum Dairy generates 50,000,000 gallons of liquid manure and process wastewater and 12,851 tons of solid manure annually.
