TOWN OF LEROY DODGE COUNTY, WISCONSIN TRAFFIC CONTROL ORDINANCE ARTICLE 1. TITLE This ordinance is entitled the Town of LeRoy Traffic Control Ordinance. ARTICLE 2. STATE TRAFFIC LAWS ADOPTED Except as otherwise specifically provided in this Chapter, the statutory provisions in Ch. 23, Ch. 30.50 to 30.71, Ch. 30.80, Ch. 30.99, Ch.167, Chs. 340 to 348 and §941.01(1), Wis. Stats., describing and defining regulations with respect to vehicles and traffic, inclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a term of imprisonment, are hereby adopted and by reference made part of this Chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this Chapter. Any future amendments, revisions or modifications of the statutes incorporated herein are intended to be made part of this Chapter in order to secure uniform statewide regulation of traffic on the highways, streets, roads and alleys of the State of Wisconsin. Sections of the Wisconsin Statutes adopted herein shall have the same number in this code proceeded by (4.) and may be so cited. ARTICLE 3. OFFICIAL TRAFFIC SIGNS AND SIGNALS A. Procure and Erect Signs. The Town Chairperson and/or Town Board are hereby authorized and directed to procure, erect or cause to be erected and maintain appropriate standard traffic signs, signals and markings conforming to the rules of this Chapter as required by State Law. Signs shall be erected in such locations and manner as the Town Board shall determine will best effect the purposes of this Chapter and give adequate warning to users of the street or highway. B. Removal of Unofficial Traffic Signs and Signals. The Town Chairperson, Town Board, and/or Sheriff’s Department subject to the approval of the Town Chairperson or Town Board, shall have the authority granted by §349.09, Wis. Stats., and are hereby directed to order the removal of a sign, signal, marking or device placed, maintained or displayed in violation of this Chapter or §346.41, Wis. Stats. Any signs which impose any immediate safety risk to pedestrians, vehicular traffic, or the public at large may be removed by the Town without prior approval but only after ascertaining, if possible, that permission has not been granted by Town Officials for posting of said signs. Any charge imposed on a premises for removal of an illegal sign, signal, or device shall be reported to the Town Board at its next regular meeting for review and certification. ARTICLE 4. INTERFERENCE WITH SIGNS AND SIGNALS PROHIBITED No person may intentionally damage, deface, move, or obstruct an official traffic sign or signal or neighborhood watch sign under Wis. Stat. § 60.23 (17m), as amended, or § 66.0429 (2), as amended, or intentionally interfere with the effective operation of such sign or signal. ARTICLE 5. PENALTY Any person who violates any provision of this chapter shall be subject upon conviction thereof to a forfeiture of not less than $50 nor more than $300 for each offense, together with the costs of prosecution. Each violation and/or each day a violation occurs or continues to exist shall constitute a separate offense. ARTICLE 6. SEVERABILITY In the event that any provision(s) hereof are determined to be contrary to any existing or future law or otherwise unenforceable, such determination shall not affect or impair the operation or enforcement of those provisions that are valid. ARTICLE 7. EFFECTIVE DATE This ordinance shall take effect one day after its passage and publication as provided by law. Dated this 14th day of October, 2024.
