Notice of Pending Application for Proposed Pond via Nonmetallic Mining Brad Plautz (Plautz Excavating & Logging, LLC), W5401 Row Rd, Merrill, WI, 54452, has applied to the Department of Natural Resources for a permit to create a pond within 500’ of a waterway (Unnamed stream WBIC 1481400) via nonmetallic mining. The project is located in the NW 1/4, SE 1/4, Section 35, Township 32 North, Range 6 East in the Town of Merrill, Lincoln County, WI. The project consists of a small quarry that plans to be 4 phases of operation. Only phases 1 and 2 (approximately 3.5 acres) are proposed to be in operation and permitted under this Ch. 30 permit. The operator plans to mine sand and gravel over the next 8-10 years (based on supply and demand) and then proceed accordingly into phases 3 and 4 for future operations. Once mining extraction is completed, the site will be reclaimed per statewide reclamation standards to a wildlife pond approximately 8 acres in size and approximately 5 feet depth on average (max 8’ deep). A wetland delineation has been completed as part of the project and no wetland disturbance or impacts are proposed. The site is located outside of the floodplain. The Department will review the proposal provided by the applicant and any information from public comments and the public informational hearing. The Department will determine whether the proposal complies with ss. 1.11, 30.19 , 30.208, 281.36, Wis. Stats., and ch. NR 150, Wis. Adm. Code, and ensure that the required mitigation meets the standards in s. 281.36(3r), Stats. if the project impacts wetlands. The Department has made a tentative determination that it will issue the permit for the proposed activity.
