ORDINANCE NO 13-24 (2024) AN ORDINANCE REPEALING AND RECREATING SECTION 12.26 WEIGHTS AND MEASURES PROGRAM; FEES The Common Council of the City of Waupaca hereby do ordain as follows: SECTION 1. Section 12.26 of the Municipal Code is hereby repealed and recreated to read as follows: 12.26 - WEIGHTS AND MEASURES PROGRAM; FEES. (1) The City of Waupaca contracts with the City of Appleton Health Department to enforce the provisions of Chapter 98, Wis. Stats., - Weights and Measures. Chapter 98, Wis. Stats., Weights and Measures, is hereby incorporated herein by reference. Every person who has weights and measures in his business or upon his premises, which are subject to the provisions of Chapter 98, Wis. Every person who employs weights or measures in his business or upon his premises who has weighing and measuring devices tested under §
98.245, Wis. Stats., or a similar statute or administrative rule in force by the Department of Agriculture, Trade and Consumer Protection and pays the required fee shall be exempt from the fee established by this ordinance. Any person claiming this exemption shall provide to the City Clerk satisfactory written proof, including a copy of the results of the testing and any other information required to make a determination that the person is exempt from this ordinance. Coin operated dryers located in apartment buildings are also exempt from the provisions of this ordinance. SECTION 2.
