ORDINANCE AMENDING THE REVISED MUNICIPAL CODE OF THE CITY OF STEVENS POINT, WISCONSIN [Chapter 23 of the Revised Municipal Code – Zoning Ordinance – Household Entity Definition] The Common Council of the City of Stevens Point, Portage County, Wisconsin, do ordain as follows: SECTION I: That Section 23.04(2), Zoning Ordinance of the Revised Municipal Code of the City of Stevens Point, shall be amended as follows: HOUSEHOLD ENTITY – is an individual, or two or more persons related by blood, marriage, adoption, foster child arrangement, or similar legal relationship and functioning as a single housekeeping entity, or such individual or person plus two individuals and their dependents, not having such similar legal relationship but functioning as a part of the single housekeeping entity. The definition of Household Entity shall not apply to a Tourist Rooming House. HOUSEHOLD ENTITY PLUS – is an individual, or two or more persons related by blood, marriage, adoption, foster child arrangement, or similar legal relationship and functioning as a single housekeeping entity, or such individual or person plus three individuals and their dependents, not having such similar legal relationship but functioning as a part of the single housekeeping entity. CITY OF HORICON RESOLUTION NO. 2025-01 WORLD MIGRATORY BIRD DAY RESOLUTION WHEREAS, migratory birds are some of the most beautiful and easily observed wildlife that share our communities, and WHEREAS, many citizens recognize and welcome migratory songbirds as symbolic harbingers of spring, and WHEREAS, these migrant species also play an important economic role in our community, controlling insect pests and generating millions in recreational dollars statewide, and WHEREAS, migratory birds and their habitats are declining throughout the Americas, facing a growing number of threats on their migration routes and in both their summer and winter homes, and WHEREAS, public aware-ness and concern are crucial components of migratory bird conser-vation, and WHEREAS, citizens enthusiastic about birds, informed about the threats they face, and empowered to help address those threats can directly contribute to maintaining health bird populations, and WHEREAS, since 1993 World Migratory Bird Day (WMBD) has become a primary vehicle for focusing public attention on the nearly 350 species that travel between nesting habitats in our communities and throughout North America and their wintering grounds in South and Central America, Mexico, the Caribbean, and the southern U.S., and WHEREAS, hundreds of thousands of people will observe WMBD, gathering in town squares, community centers, schools, parks, nature centers, and wildlife refuges to learn about birds, take action to conserve them, and simply to have fun, and WHEREAS, while WMBD officially is held each year on the second Saturday in May, its observance is not limited to a single day, and planners are encouraged to schedule activities on the dates best suited to the presence of both migrants and celebrants, and WHEREAS, WMBD is not only a day to foster appreciation for wild birds and to celebrate and support migratory bird conservation, but also to call to action, NOW THEREFORE, I, Joshua Maas, as Mayor of the City of Horicon, Wisconsin, do hereby proclaim May 10, 2025 as World Migratory Bird Day in the City of Horicon, and I urge all citizens to celebrate this observance and to support efforts to protect and conserve migratory birds and their habitats in our community and the world at large. ORDINANCE 1449 CHANGES TO §9.47 OF THE MUNICIPAL CODE TO PROHIBIT SEXTING 1. Definitions a. “Nudity” means the showing of the human male or female genitals, pubic area, or buttocks with less than a fully opaque covering; or the showing of the female breast with less than a fully opaque covering of any portion thereof below the top of the nipple; or the depiction of covered male genitals in a discernibly turgid state. A mother's breastfeeding of her baby does not under any circumstance constitute "nudity," irrespective of whether or not the nipple is covered during or incidental to feeding. This section applies to representative, virtual, purported, modified, or manipulated images reasonably representing or purporting to represent a human being. b. “Harmful to Minors” means any reproduction, imitation, characterization, description, exhibition, presentation or representation, of whatever kind of form, depicting nudity, sexual conduct, or sexual excitement when it: 1) Predominately appeals to prurient, shameful, or morbid interest; 2) Is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable material or conduct for minors; and 3) Taken as a whole, is without serious literary, artistic, political, or scientific value for minors. c. “Minor” means any person under the age of 18 years. 2. A minor commits the offense of sexting if he or she knowingly: a. Uses a computer, or any other device capable of electronic data transmission or distribution, to transmit or distribute to another minor any photograph or video of any person which depicts nudity, as defined above, and is harmful to minors, as defined above. b. Possesses a photograph or video of any person that was transmitted or distributed by another minor who depicts nudity, as defined above, and is harmful to minors, as defined above. A minor does not violate this paragraph if all of the following apply: 1) The minor did not solicit the photograph or video 2) The minor took reasonable steps to report the photograph or video to a school or law enforcement official. 3) The minor did not transmit or distribute the photograph or a video to a third party other than a law enforcement official. c. Uses a computer, or any other device capable of electronic data transmission or distribution, to transmit or distribute to another minor any text, correspondence, or message of a sexual nature when it: 1) Predominately appeals to a prurient, shameful, or morbid interest; 2) Is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable material or conduct for minors; and 3) Taken as a whole, is without serious literary, artistic, political, or scientific value for minors. d. Solicits the transmission or distribution of any text, correspondence, message, photograph or video from another minor that would itself be prohibited under this section 9.47 of the Municipal Code. 3. Any person who shall violate this section prohibiting “sexting” shall pay a forfeiture plus costs established in Ordinance 25.04 of the New London Municipal Code.
